These General Terms and Conditions govern the access to the Fondaco dei Tedeschi viewing terrace through the use of the booking system provided by Booxi Inc.
The following definitions shall apply to these General Terms and Conditions, it being understood that definitions in the plural shall apply to the corresponding term in the singular and vice versa:
Booxi: is the company Booxi Inc., partner of the LVMH Group in the provision of reservation services, in charge of managing the booking system for access to the panoramic terrace of the Fondaco dei Tedeschi.
Customer: the person who books a visit to the Fondaco dei Tedeschi Roof Terrace via Internet (e.g. websites and tablet/smartphone applications).
Contract: is the agreement concluded between the Customer and Fondaco dei Tedeschi and, as far as they are concerned, with Booxi, in relation to a specific reservation for access to the Fondaco dei Tedeschi's roof terrace, to be understood as governed by these General Terms and Conditions, by the various rules indicated, if applicable, in the various steps of the electronic reservation process and by the warnings on the reservation confirmation.
Ticket Holder: the person who is the legitimate holder, in accordance with these General Terms and Conditions, of a ticket issued on the basis of a reservation made by the Customer.
Terrace: the panoramic terrace of the Fondaco dei Tedeschi to which the Access Ticket refers.
Fondaco dei Tedeschi: is the entity where the Terrace is located, in respect of which the Access Ticket is issued, and manages access to the Terrace.
Access Ticket: is the document, also in digital format, issued by Fondaco dei Tedeschi through Booxi, which authorizes the holder of the Access Ticket and any other 4 booked persons expressly indicated in the Access Ticket, to access the Terrace on the day and at the time indicated in said Access Ticket.
All persons wishing to access the Terrace must be in possession of a valid Access Ticket.
The Access Ticket must be obtained through the booking system on the Fondaco dei Tedeschi website.
The reservation may be made by the Customer for a total number of persons not exceeding 5.
In the event that the Access Ticket is obtained by the Customer by means other than those indicated above, or if the Access Ticket is lost, stolen, duplicated, or obtained in violation of these General Terms and Conditions, the Ticket Holder and the persons booked as indicated on the Access Ticket shall not be authorized by Fondaco dei Tedeschi to access the Terrace.
Access to the Terrace will be granted to the Holder of the Access Ticket and to a maximum of 5 other persons booked on the Access Ticket, on the day and at the time indicated on the Access Ticket. The visit to the Terrace lasts 15 minutes.
Fondaco dei Tedeschi reserves the right to check the validity of the Access Ticket and to refuse access to the Terrace outside the hours indicated on the Access Ticket or to persons not indicated on the Access Ticket.
Access to the Terrace is free of charge and therefore the Access Ticket may not be transferred or brokered by the Customer or the Ticket Holder for consideration.
Fondaco dei Tedeschi has the right to cancel an Access Ticket already issued for its own organizational needs or if problems or inconsistencies are detected in relation to the reservation of the Access Ticket made by the Customer. This may happen, for example, but not exclusively, if the Customer makes a number of bookings in excess of the number allowed for each Customer.
At the end of the booking process, the Customer, and the maximum number of 5 participants specified by the Customer, if the Customer so chooses, will each receive a booking confirmation at the e-mail address specified during the booking process. The booking confirmation will include the Access Ticket which must be presented at the entrance to the Terrace in order to gain access. The mere presentation of the booking confirmation will not be considered valid for access.
Fondaco dei Tedeschi reserves the right to close access to the Terrace without prior notice, at its own discretion, in case of bad weather or for safety reasons. In this case, the Access Tickets will be considered cancelled and Fondaco dei Tedeschi will not be liable to the Customer, the Ticket Holder or the persons booked.
The Customer can obtain assistance with any booking issue by writing to the e-mail address fondaco.receptions@dfs.com.
Access Tickets may not be used for political, commercial, advertising or other promotional reasons (such as, for example, prizes in competitions).
Even in the event that any of the provisions of these General Terms and Conditions are inapplicable, the others shall continue to be fully effective.
The Contract is subject to Italian law. Any and all disputes arising out of or in any way connected with the Contract and these General Terms and Conditions shall be settled by the Court of Venice.
The present General Contract Conditions, the various rules indicated in the various phases of the electronic booking process, when applicable, and the warnings on the Access Certificate constitute the entire contractual agreement between the Client and Fondaco dei Tedeschi.
In case of conflict between the provisions of these General Terms and Conditions, as published in Italian, and the corresponding text published in a foreign language, as well as in case of conflict between the Italian version and the foreign version of any other content of the Contract, the Italian language version shall prevail.
